2. Humanitarian Protection

VAWA: Green Card Application for Victims of Domestic Violence

The VAWA (Violence Against Women Act) visa provides immigration protection for victims of domestic violence, abuse, or cruelty (regardless of gender). Victims can apply for a green card without relying on the abuser, and applicants need to provide evidence of the marriage's authenticity, the abuse experienced, and good moral character.

TPS: Temporary Protected Status

Temporary Protected Status (TPS) is available to nationals of certain countries who cannot safely return home due to natural disasters, armed conflicts, or other extraordinary conditions. Under TPS status, applicants can legally live and work in the U.S., but the status is temporary and does not lead directly to permanent residency.

DED: Deferred Enforced Departure

Deferred Enforced Departure (DED) is authorized by the U.S. President and offers temporary protection to nationals of specific countries, preventing them from being deported. Similar to TPS, but DED is based on presidential executive orders rather than legislative action.

Asylum: Assistance for Asylum Seekers

Asylum is for individuals who have suffered persecution or have a well-founded fear of persecution due to race, religion, nationality, political opinion, or membership in a particular social group. Applicants must file for asylum within one year of entering the U.S. and provide credible evidence of persecution.

Uand T Visas: For Victims of Crimes and Human Trafficking

The U visa is for victims of serious crimes (such as domestic violence, sexual assault, kidnapping, etc.) who are willing to cooperate with law enforcement in investigations and prosecutions. The T visa specifically aids victims of human trafficking, allowing them to obtain temporary status and eventually apply for a green card.

Deferred Action: Temporary Permission to Stay in the U.S.

Deferred Action is an administrative decision that temporarily postpones the removal action of an individual. This status does not provide lawful immigration status, but holders may apply for work authorization.

Removal of Deportation Orders

The Removal of Deportation Orders service helps individuals who have received deportation orders to cancel or delay the removal through legal processes, avoiding forced return to their home country.

SIJS: Special Immigrant Juvenile Status

Special Immigrant Juvenile Status (SIJS) provides immigration protection for minors who have been abandoned, abused, or neglected. When a court determines that a child cannot return to their home country safely, SIJS allows them to apply for a green card and gain long-term legal status.
